Rental Contracts

Energy Performance Certificate
An Energy Certificate is required when selling or letting your property in Spain. If the property or building is a new build, then responsibility lies with the developer. The energy certificate is a document that will describe how effective a property is in terms of energy use and it is valid for 10 years. The Energy Rating of the property is determined by a label and Certification. This document is governed by Real Decreto 235/2013 of 5th April, which approves the Basic Procedure for the Certification of Energy Efficiency of Buildings.

Habitation Certificate
A Habitability Certificate is required when selling your property in Spain. All new properties in Spain are issued with a Habitation Certificate (Certificate of First Occupancy). This document shows that the property is registered correctly and that the builder has fulfilled the necessary legal obligations. This document is issued by the local Town Hall. The Habitation Certificate is a requirement to enable the registration and changeover of the utility services. This document is renewable after a certain period of time, dependant on the area, and is later known as Certificate of Second occupancy.
